Unlawful Use of Badges of Certain Orders, Organizations and Other Groups

If you wear the badge or button of any of the following groups and you are not a member of that group or society or otherwise entitled to wear the badge or button, you may be charged with a second-degree misdemeanor:

  • Military Order of the Loyal Legion of the United States
  • Military Order of Foreign Wars of the United States
  • Patrons of Husbandry
  • Benevolent and Protective Order of Elks of the United States of America
  • Woodmen of the World
  • Any society, order or organization of five years' standing in the state of Florida

A second-degree misdemeanor is punishable by up to 60 days of incarceration and/or a fine of up to $500.

Furthermore, if you wear the badge, button or other insignia of the American Legion and you are not a member of the American Legion, you may be charged with a second-degree misdemeanor.

If you wear or display a badge, button, insignia or any other emblem of the following while not entitled to do so, you may be charged with a first-degree misdemeanor:

  • Benevolent organization
  • Fraternal organization
  • Social organization
  • Humane organization
  • Charitable organization

A first-degree misdemeanor is punishable by up to one year of incarceration and/or a fine of up to $1,000.
